QUEER QUEENS TRAVEL BOOKING AND PURCHASING TERMS AND CONDITIONS

This website is operated by Queer Queens Travel. Throughout the site, the terms “we”, “us” and “our” refer to Queer Queens Travel. Queer Queens Travel offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
These conditions apply to online bookings/ purchases you make on our website [https://www.queerqueenstravel.com] and any forms and/or agreements submitted/ agreed to outside of this website via email, google forms, pdf etc.
A contract on the terms set out in these Booking Conditions will exist as soon as we issue a confirmation invoice after receipt of your deposit(1) OR the full payment of your trip balance(2).

UNDERSTANDING YOUR CONTRACT
Please read these Conditions carefully. You must not make any booking/purchase unless you understand and agree with these conditions.

TRAVEL SERVICE/ ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 1: BOOKING TERMS AND CONDITIONS
The information provided below is specific to our travel services.

QUEER QUEENS TRAVEL BOOKING SPECIFICATIONS:

In order to book with Queer Queens Travel you must be 21+ and identify as a Queer Woman of Colour. Queer Queens Travel is committed to providing group trip experiences to Queer Women of Colour therefore booking priority will be given to QWOC.

BOOKING PRICES, PAYMENTS AND CANCELLATIONS

All prices are subject to availability and can be withdrawn or varied without notice. Prices are per person and inclusive of tax unless otherwise indicated.

Prices are not guaranteed until a deposit or full payment is made.

To confirm your travel arrangements you will be required to pay a deposit per person.

All deposits are non-refundable for changes of mind or cancellations.

Deposits are included in all payments whether the payment was made in full or a larger amount was applied to the trip. Please view the information for each trip to be made aware of the deposit amounts.

For bookings made less than 30 days prior to departure, full payment is required at the time of purchase; no deposit or payment plans will be offered.

Payment arrangements must be honoured, all payments are to be received on the dates indicated on the arrangement, unless discussed with Queer Queens Travel.

Currency

Prices are listed in US Dollars and invoiced in Canadian dollars due to Queer Queens Travel being based in Canada. All prices are subject to currency conversion at the time of payment.

LATE/MISSED PAYMENTS

Payment schedules are indicated in your initial registration email and it is your responsibility to ensure you make your payments on the due dates. Please keep in mind we are very reasonable and with effective communication adjustments can be made for payment dates.

The following penalties will be applied to the balance of your trip:

First late payment: Grace period of 5 days after the due date. A $20 late fee will be applied each day the payment is late.

Second Late Payment: Grace period of 2 days after the due date. A $25 late fee will be applied each day the payment is late.

Third late payment: We will require the trip be paid off immediately or you will forfeit your NON-REFUNDABLE spot.

Late payments of 10 days or more: If a payment hasn’t been received and there has been no communication with a representative of Queer Queens Travel in writing, you will forfeit your spot on the trip. Queer Queens Travel reserves the right to keep all monies paid as a cancellation/non-payment fee after 10 days of non-payment.

IF YOU CANCEL YOUR BOOKING

You may cancel your travel arrangements at any time before the trip departure. However please note you may lose part or all of your money paid.

The cancellation fees will be an amount determined in accordance with the information below, except where otherwise indicated.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim these charges from your travel insurer.

Refunds will only be made available to the person named on the booking payment receipt.

Unless otherwise indicated, the following cancellation fees apply to package bookings:

For trips scheduled/ released 6 months or less

For trips released/scheduled 6 months or more:

Less than 6 months	Full Value of Package

You may be able to reclaim cancellation charges under the terms of your insurance policy. Claims must be made directly with your insurance company.

Once the trip has begun, no refunds can be issued.

All prices are based on group bookings, therefore, no refunds will be made on any parts of the itinerary in which you do not wish to participate.

FOREIGN CURRENCIES
We accept payments in all currencies. Please note that foreign currencies may incur additional charges from your bank or financial institution any refunds issued will be subject to the exchange rate at the time of the refund.

TRANSFERRING/ SELLING YOUR SPOT
If you choose to no longer attend the trip you have the option to find someone to take your spot.
Once you have found someone to take your spot you must send written confirmation to Queer Queens Travel via email stating you will no longer be attending the trip and who will be replacing you.
Once we are provided with this information we will send the appropriate documents/contracts to the person indicated in the email and only after they have completely agreed to the terms and conditions will the transfer be complete.
You must arrange payment among yourselves, Queer Queens Travel will not issue any refunds. Please ensure that the person you have chosen fills out all appropriate paper work prior to the funds exchange.
This person will be responsible for making the remaining payments as per your payment schedule.

ITINERARY CHANGES AND CANCELLATION
The arrangements advertised by us are given in good faith. As arrangements are planned so far in advance, it may occasionally be necessary for us to make changes and we reserve the right to do so at any time.
Any decision to change or cancel the tour may be due to weather conditions, political conditions and other factors beyond our control.
Any decision made to change or cancel the tour will be made in the best interest of all participants with regards to the safety of the group.
If a trip must be delayed, or the itinerary changed due to unforeseeable circumstances such as weather, transportation delays, political turmoil, the cost of delays or changes is not included.
In the event that the trip has to be cancelled, we will refund the full paid amount, excluding deposit promptly.
We will not, however, be responsible for any expenses incurred in preparation for travel or the trip experience.

TRAVEL INSURANCE
Is optional but we do recommend getting insurance when travelling with us.
QQT will not be held liable for any loss, injury or death whatsoever please view full terms in the: DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY section.
Your insurance should include medical cover and personal accidents. You should ensure that your personal travel insurance provides protection for the full duration of the trip in respect of at least medical expenses, injury, death, repatriation, cancellation and curtailment with adequate and appropriate cover including medical emergency helicopter repatriation.
You should ensure that there are no exclusion clauses limiting or excluding protection for the type of activities included in your trip. You must ensure that all travel insurance purchased meets your particular personal requirements and you should arrange supplementary insurance if necessary.
It is your responsibility to ensure you have valid travel insurance that covers and is appropriate for your needs.
We will not be liable for any loss you incur if and insofar as you are able to claim for damages under a travel insurance policy.
You are required to carry proof of insurance with you and produce it if reasonably requested by us or our suppliers. Failure to do so may result in your being prevented from participating in certain activities without the right to any refund.

PASSPORT & VISAS
All travelers must have a valid passport for any international travel and many countries require at least six months’ validity from the date of return.
Some countries also require a machine-readable passport and/or unstamped available pages.
When you book a trip with us, we will assume that all travelers on the booking have a valid passport. If this is not the case, you must let us know.
It is important that you ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities (including, in certain cases, visas for transit points).
Any fines, penalties, payments, delays or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.

SPECIAL REQUIREMENTS AND MEDICAL PROBLEMS
If you have any special request, you must advise us at the time of booking and clearly note it on your booking form. Although we will endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot guarantee any request will be complied with unless we have confirmed this in writing.
Confirmation that a special request has been noted or passed on to the supplier or the inclusion of the special request on your confirmation or any other documentation is not confirmation that the request will be met unless and until specifically confirmed.
All special requests are subject to availability.
If you or any member of your party have any medical problem or disability, which may affect your holiday, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements.
In any event, you must give us full details in writing at the time of booking.
If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking, cancel when we become aware of these details.

PRIVACY NOTICE AND OVERSEAS TRANSFERS
We are committed to protecting your personal information and will process your personal information in accordance with our Privacy Notice, available online at [https://queerqueenstravel.com] By providing personal information to us, you agree that our Privacy Notice will apply to how we handle your personal information and you consent to us collecting, using, disclosing and otherwise processing your personal information as detailed in our Privacy Notice.
In particular, you agree that in certain circumstances (such as where to fulfill the services on your trip), we are permitted to disclose your personal information to overseas recipients.
Generally, we will only disclose your personal information to these overseas recipients in connection with facilitation of your travel booking and/or to enable the performance of administrative and technical services by them on our behalf.
Where your requested travel arrangements require that your personal information be sent to an overseas recipient (other than any of our overseas related entities), you agree that this is at your risk and we will not be liable or accountable for how those recipients handle your personal information.

Section 2: GENERAL TERMS AND CONDITIONS
The information provided below is applicable to all products and services offered by Queer Queens Travel.

MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

PRODUCTS OR SERVICES
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Returns- MERCHANDISE(not including travel services) purchased via the site or in person
No Refunds/Exchanges
We do not accept returns or exchanges unless the item you purchased is defective. If you receive a defective item, please contact us at queerqueenstravel@gmail.com with details of the product and the defect. Once the claim is received further instructions as to where to send the merchandise will be provided
Upon receipt of the returned product, we will fully examine it and notify you via e-mail, within a reasonable period of time, whether you are entitled to a replacement as a result of the defect. If you are entitled to a replacement we will replace the product.

Certain content, products and services available via our Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
